General
These Terms and Conditions apply to orders of products and programs from Pivot Point Europe BV. Ordering products and programs from Pivot Point Europe BV. means that the Terms and Conditions have been understood and accepted. The present terms and conditions also apply to future business relationships, even if they are not expressly agreed again.

Ordering and Payment
You can order your products through the order form on this website. Once the order has been placed, a confirmation document will be sent by Email with the request to make payment in our bank in the Netherlands. All products ordered from our site must be paid in advance. If an item is out of stock, the user will be informed immediately.
Prices
All prices are indicated on the website. Prices are excluding shipping and packaging costs, and excluding VAT. The price of the goods will be the price quoted on the confirmation document, including shipping and packaging costs, and including VAT. The actual invoice will be sent by email. Prices are in €. If you indicate your VAT number on your order we will evaluate of we can invoice without VAT. If you do not indicate any VAT number then VAT will be charged when applicable.

Delivery
Delivery will be made by Couriers. Deliveries are made on weekdays, Monday to Friday. Precise delivery times will depend on the level of stocks. Deliveries are only made after receipt of payment.
It is important to ensure that you give the correct delivery address, including a telephone number and the name of a contact person and that there is someone to sign for the goods. When goods are returned due to lack of a signature, it will be subject to another delivery charge.
Cancellation and Refunds
For consumer protection, you have the right to cancel the order within the term of 7 working days. The 7 working day period begins the day after the day on which you receive the goods. You must inform Pivot Point Europe BV. by letter or email (jlaan@pivot-point.com) within 7 working days of your desire to cancel the order. All expenses for the return of the goods are at the customer’s expense. The payment of the returned product will be refunded through the original payment method.
The goods must be returned in an unused condition and in the original packaging. Once the returned goods are received in this condition at Pivot Point’s warehouse, a refund will be made.
Returned Merchandise
The goods must be returned in the original condition. Please send an email to jlaan@pivot-point.com to get authorization and the address for the return to Pivot Point Europe BV. The customer will arrange for the shipment of the product through the courier. When the returned goods were defective, Pivot Point will arrange for the replacement immediately as soon as the defective goods are received in our warehouse.
Warranty for Hair Products and Other Products
Hair products and other products are guaranteed to the original buyer for a period of one year from the date of purchase, with normal use, against defects in material or workmanship. During the warranty period, Pivot Point will replace the hair product when returned with a copy of the original receipt, a copy of the original label containing the production batch number and date, and a letter describing the defect.
Books must be returned unopened.
Tools must be returned in the original packaging and in the original state. Any missing items from the kit will not be credited or replaced. If there is a missing item, an individual list price will be charged for that item.
Copyright
Pivot Point International, Inc. is the owner of all copyrights in the United States and in other countries worldwide of all programs, books, DVDs with the Pivot Point brand. This means that, subject to some limited exceptions, only Pivot Point has the right to copy, reproduce, distribute, or display the works in print or electronic versions. There is no specific number of words, lines, or images that can be copied from these materials without permission. Similarly, even recognizing Pivot Point as the source of the protected material does not allow anyone to copy the contents. Therefore, unless he/she can prove that he/she is subject to one of the limited exceptions discussed below, copying all or part of these materials without the express authorization of Pivot Point is prohibited.
Some countries allow limited copying of portions of copyrighted materials if such copying constitutes “fair use” or “fair dealing.” But copying is prohibited if the intended use is commercial; if the amount and substance of the portion used is substantial in relation to the work as a whole; and if the effect of the use damages the potential market or value of the program, book, DVD, etc., to Pivot Point Europe BV. In short, commercial use involving a significant amount of the copyrighted material, or a critical portion of the copyrighted material, or negatively impacting Pivot Point Europe BV.’s ability to sell its copyrighted material will not be considered “fair use.”
In short, in general no one has the right to copy Pivot Point’s copyrighted works. Recognizing Pivot Point as the source does not allow copying. Non-commercial use does not allow copying. Reproducing a couple of images or quoting a maximum of 300 words is not permitted. Violation of copyrighted works carries serious penalties, including injunctions, seizure and forfeiture of counterfeit items, actual damages and profits, or statutory damages, which can range up to $150,000 per work in case of intentional infringement. Additionally, United States law provides that a person who knowingly infringes a copyright for commercial advantage or private financial gain or by reproducing one or more copies of protected works that have a total retail value of more than $1,000 may be subject to imprisonment and fine.
